Terms of Service

1. Acceptance

By using our website, engaging our services, or signing a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Nature of Services

ELELAND COMPANY LIMITED operates as a digital marketing and e-commerce agency. Services include but are not limited to Meta (Facebook / Instagram) advertising, Google Ads campaign management, SEO/SEM, social media content management, outsourced customer service, e-commerce operations, and web development. The specific scope, timeline, and fees for each engagement are set out in the signed service agreement or written confirmation between us and the client.

3. Client Obligations

Clients are responsible for providing accurate company information, granting the necessary platform access (e.g. Meta Business, Google Ads), supplying product information, approving advertising creatives, and approving budgets. The client retains responsibility for the legality, accuracy, and intellectual property rights of any materials they provide or authorize us to use.

4. Third-Party Platforms

We deliver agency work through third-party platforms (e.g. Meta, Google, Shopify, Shopline). Use of those platforms is also subject to their own terms and policies. We are not responsible for platform changes, outages, account suspensions, or policy decisions made by those platforms.

5. Fees and Payment

Service fees and advertising spend are settled per the client's service agreement. Advertising budgets are typically paid by the client directly to the platform, or reimbursed to us where we have prepaid on the client's behalf. We may pause services for accounts in arrears.

6. Intellectual Property

The ELELAND website, brand name, logo, copy, and methodology are owned by ELELAND COMPANY LIMITED. Custom client deliverables produced under an engagement transfer to the client upon full payment, unless otherwise agreed in writing.

7. Limitation of Liability

To the maximum extent permitted by law, our services are provided "as is". We do not guarantee specific advertising performance or sales outcomes. We are not liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes will fall within the exclusive jurisdiction of the Hong Kong courts.
